How Long Do You Have to File a Medical Malpractice Lawsuit in Maryland?

In Maryland, the statute of limitations to bring a medical malpractice claim can either be three years or five years. If you knew or should have known about the mistake, then it’s three years. If there was no way to learn about it and you learn about it at a later date, or after that three-year period, you have up to a maximum of five years. Also, if you’re a minor, you can bring your claim as soon as you turn 18, but you can’t bring it any later than 21. So you can have potentially up to 18, but no later than 21 years old to bring a medical malpractice claim in Maryland.
