Most car crashes are a result of negligence. In other words, the other driver didn’t intentionally cause the crash, but wasn’t paying attention for any number of reasons. It experienced a cell phone usage or so many other distractions when their focus should be on the road in front of them. But if all litigation is necessary and you decide to file a lawsuit in your injury claim, your lawyer, while technically may sue the other driver, it is the insurance company that pays the settlement or the verdict. That is why we’re all required to purchase auto insurance if we buy or drive a car so that insurance will pay for any damage or injury and negligent driver causes.
