What to Do If an Insurance Company Denies Your Maryland Car Accident Claim

If the other driver’s insurance denies your claim after a car accident—and we know they caused the accident—this just goes back to what the insurance companies do. They delay and they deny. They can take advantage in Maryland of this contributory negligence law; I mean, they do it all over the country, but particularly in Maryland. We get denials every day. I’d say the majority of them are bad faith. A lot of times, I hear our clients say, “Well, you know, the driver kind of apologized to me, said he was sorry.” We open up a claim the next day—claim denied.

And so what happens is the insurance companies deny claims all the time in Maryland after a car accident. And quite frankly, even when we get evidence during our investigation process in the first couple weeks—and we get photographs, or we get a witness statement that’s favorable to us, an independent witness, a couple other scenarios where we investigate and we know our client did nothing wrong—it’s not going to change their mind.
